What is a Wasiat?

A Wasiat is a declaration made by a Muslim during his lifetime regarding the distribution of his property or beneficial interests, to be carried out after his death. It serves as a vital act of responsibility — ensuring that one’s wealth continues to benefit the rightful recipients and supports causes that bring ongoing reward (pahala jariah).

Without a Wasiat?

For Muslims who pass away without a Wasiat, their estate will be distributed strictly according to Faraid. While fair, this predetermined method does not cater to specific wishes such as:

  • Providing for non-Faraid beneficiaries (e.g., adopted children).
  • Leaving a legacy gift for charity (amal jariah).
  • Appointing a trusted executor to manage the estate.

Who Are the Legal Heirs?

Primary heirs (husband, wife, parents, legitimate children) are always entitled under Faraid. However, a Wasiat is essential for loved ones excluded from Faraid, including:

  • Adopted or foster children
  • Non-Muslim family members
  • Specific charitable bodies

Islam grants you the right to bequeath up to one-third (⅓) of your assets.
